If you used a finger scan timekeeping system at an Aryzta facility in the State of Illinois between August 17, 2012 and August 7, 2020, you may be entitled to a payment from a class action settlement.

A Settlement has been reached in a class action lawsuit between ARYZTA, LLC (“Defendant” or “Aryzta”) and certain individuals who worked or work at an Aryzta facility in Illinois and used a finger scan timekeeping system. The suit alleges that Defendant violated an Illinois law called the Biometric Information Privacy Act (“BIPA”) by collecting employees’ biometric data on finger-scanning time clocks in Illinois without obtaining their informed written consent. Defendant denies any wrongdoing and maintains that it has not violated any laws. The lawsuit does not allege, and Defendant denies, that there has been any hack or unauthorized data breach of data maintained by Aryzta or ADP LLC. Both sides agreed to the settlement to resolve the case. The settlement does not establish who is correct, but rather is a compromise to end the lawsuit and avoid the uncertainties and expenses associated with ongoing litigation. The Court has taken no position and has not made any rulings on the merits of the claims of the lawsuit.



YOUR LEGAL RIGHTS AND OPTIONS IN THIS SETTLEMENT


DO NOTHING
You will receive a payment under the Settlement and give up your rights to sue Aryzta and certain related persons and entities about the issues in this case.
EXCLUDE YOURSELF
You will receive no payment, but you will retain any rights you currently have to sue Aryzta about the issues in this case.
OBJECT
Write to the Court explaining why you don't like the Settlement. 
ATTEND A HEARING 
Ask to speak in Court about the fairness of the Settlement. 

These rights and options—and the deadlines to exercise them—are explained in the Notice. 

 The Court in charge of this case still has to decide whether to approve the Settlement. Payments will not be issued until the Settlement is approved. Please be patient.
